Terms of Use

1. Acceptance

By downloading, installing, or using the Parched application ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App. These terms are governed by the laws of England and Wales.

2. The service

Parched provides daily watering recommendations ("verdicts") for allotments and gardens based on publicly available weather data and a soil moisture model. The App is provided for personal, non-commercial use.

Parched is a decision-support tool. Verdicts are advisory only. Weather data is sourced from third-party services and may occasionally be unavailable, delayed, or inaccurate. You remain responsible for your own judgement when watering your plants.

3. Accuracy and availability

We aim to provide reliable, timely verdicts but we do not guarantee that:

The App will be available at all times or free from interruptions or errors
Weather station data will be available for all UK locations
Watering verdicts will always be correct for your specific conditions
The App will be compatible with every iOS device or future iOS version

We are not liable for any crop loss, watering over- or under-supply, or other outcomes arising from reliance on the App's verdicts.

4. Subscriptions and in-app purchases

Parched offers a free tier and an optional Parched Pro subscription ("Pro"), available as a monthly or annual auto-renewing subscription purchased through Apple's App Store.

Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
Annual subscriptions include a free trial period as advertised in the App; the trial period and duration may change at any time.
You can manage or cancel your subscription at any time via Settings → Apple ID → Subscriptions on your iPhone.
No refunds are provided for unused portions of a subscription period, except as required by applicable law or Apple's own refund policy.
All prices are displayed inclusive of applicable tax.

All payment processing is handled by Apple. We do not receive or store your payment information.

5. Intellectual property

All content, design, code, and branding within the App is owned by or licensed to Jason Nichols. You may not copy, modify, distribute, or reverse-engineer any part of the App without prior written permission.

Crop data and weather data sourced from third-party public APIs remain the property of their respective providers.

6. Prohibited use

You agree not to:

Use the App for any unlawful purpose
Attempt to access or tamper with the underlying code or data of the App
Resell, redistribute, or commercially exploit the App or its outputs
Use automated tools to scrape or extract data from the App

7. Limitation of liability

To the fullest extent permitted by law, Parched and Jason Nichols shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

Our total aggregate liability to you for any claim arising out of these terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded.

8. Changes to the App and terms

We may update the App, modify features, or change these Terms of Use at any time. We will update the "Last updated" date when material changes are made. Continued use of the App after a change constitutes your acceptance of the revised terms.

We reserve the right to discontinue the App or any feature of it at any time without notice.

9. Third-party services

The App connects to third-party weather APIs (Open-Meteo, Environment Agency, NOAA) to retrieve data. We are not responsible for the availability or accuracy of these services, and their own terms and policies apply to their data.

10. Governing law

These Terms of Use are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
